Welcome to Gryphon Online Safety, Inc.'s Network Protection Service! These Terms of Service ("Terms") outline the terms and conditions under which we provide our network protection services to you, our valued customer. By using our services, you agree to be bound by these Terms. Please read them carefully.

2. Definitions

"Service": Refers to the network protection services provided by Gryphon Online Safety, Inc.

"Customer": Refers to the entity or individual receiving Gryphon Online Safety, Inc.'s network protection services.

3. Automatic Monthly Billing

3.1. Billing and Payment

(a) The Customer agrees to pay all fees associated with the Service as outlined in the pricing plan selected at the time of purchase

(b) Monthly billing will be automatically processed on the monthly anniversary of each month when you started the service.

(c) Payment is due within 10 days from the date of the invoice.

3.2. Updating Payment Information

(a) The Customer is responsible for ensuring that their payment information, such as credit card details, remains current and valid

(b) Gryphon Online Safety, Inc. will attempt to process payment using the provided information. In case of payment failure, Gryphon Online Safety, Inc. will notify the Customer to update their payment details within [number of days] days.

3.3. Late Payment and Suspension

(a) In the event that payment is not received within the specified time frame, Gryphon Online Safety, Inc. reserves the right to suspend or terminate the Service without notice.

(b) Late payment may result in the accrual of interest charges at a rate of [interest rate] per month on the outstanding balance.

3.4. Reactivation of Service

(a) If the Service is suspended or terminated due to non-payment, the Customer may request the reactivation of the Service upon settling all outstanding fees and charges, including any reactivation fees.

4. Return of Equipment

4.1. Equipment Ownership

(a) Any equipment provided by Gryphon Online Safety, Inc. to the Customer during the provision of the Service remains the property of Gryphon Online Safety, Inc. unless otherwise specified in a separate agreement.

(b) The Customer is responsible for the safekeeping of equipment provided by Gryphon Online Safety, Inc. and shall not alter or modify it without prior written consent.

4.2. Return of Equipment upon Termination

(a) In the event of termination of the Service, for any reason, the Customer is responsible for returning all equipment provided by Gryphon Online Safety, Inc. within 30 days from the date of termination.

(b) The Customer is responsible for all shipping and handling costs associated with the return of equipment.

(c) Equipment must be returned in the same condition as when received, normal wear and tear excepted.

(d) Failure to return equipment within the specified time frame may result in additional charges or fees.

5. Limitation of Liability

(a) Gryphon Online Safety, Inc. shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service.

(b) In no event shall Gryphon Online Safety, Inc.'s total liability to the Customer exceed the total fees paid by the Customer for the Service in the preceding 6 months.

6. Electronic Communications

(a) By using the Service, you consent to receiving electronic communications from Gryphon Online Safety, Inc., including but not limited to emails, notices, and messages.

7. Disclaimer of Warranty

(a) Gryphon Online Safety, Inc. provides the Service "as is" and makes no warranties or representations, whether express or implied, regarding the Service, including but not limited to its accuracy, reliability, or fitness for a particular purpose.

8. Class Action Waiver

(a) The Customer agrees that any claims or disputes against Gryphon Online Safety, Inc. must be brought individually and not as part of a class action or consolidated action.

9. Use of Arbitration

(a) Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10. Company's Right to Terminate Service for Any Reason

(a) Gryphon Online Safety, Inc. reserves the right to terminate the Service for any reason, including but not limited to violation of these Terms or any applicable laws or regulations, without notice.

These Terms are governed by and construed in accordance with the laws of the state of California, including applicable provisions of the California Consumer Privacy Act (CCPA).
